Despite Musk’s attempts to keep the hearing confidential, the West Lake Hills city attorney denied this request. Subsequently, Musk’s appeal regarding the fence and gate was addressed during a public meeting held by the Zoning and Planning Commission.

During this meeting, city staff recommended allowing Musk to retain the fence and gate, albeit with specific alterations. However, some commission members raised questions regarding the appropriateness of the proposal.

Ultimately, the commission voted against granting Musk the exceptions he sought for the unauthorized structures. The case has now been forwarded to the City Council for further consideration, with a meeting initially scheduled for May 14 being postponed to June 11 at Musk’s request.

An attorney representing Musk claimed that numerous security personnel, including federal marshals, warranted a closed meeting in compliance with a Texas statute regarding security deliberations. However, these arguments were ultimately dismissed by the city attorney.
